By accessing or using MySmartAds ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

MySmartAds is an AI-powered video advertisement creation platform that enables users to generate professional video ads using artificial intelligence technologies including script generation, text-to-speech synthesis, avatar rendering, and video composition.

3. Acceptable Use Policy

You agree to use MySmartAds only for lawful purposes. The following are strictly prohibited:

• NSFW, adult, or sexually explicit content — Generation of any sexually explicit, adult, or NSFW (Not Safe For Work) content is strictly prohibited.
• Nudity or pornographic material — Any content depicting nudity or pornography is forbidden.
• Hate speech or discrimination — Content that promotes hatred, discrimination, or violence based on race, religion, gender, sexual orientation, or nationality.
• Harassment or threatening content — Content designed to harass, threaten, or harm individuals.
• Misinformation or deceptive content — False or misleading claims in advertisements.
• Illegal products or services — Advertising of illegal products, controlled substances, or prohibited services.
• Copyright infringement — Content that violates third-party intellectual property rights.
• Malicious content — Any content designed to harm, defraud, or deceive others.

⚠️ Content Moderation: All content submitted to MySmartAds is subject to automated content moderation. We reserve the right to reject, remove, or flag any content that violates these terms. Repeated violations may result in account suspension or termination.

4. Credits and Payments

MySmartAds operates on a credit-based system. Each video generation consumes one credit. Credits are available through monthly subscription plans or one-time credit packs. All payments are processed securely through Creem. Refunds are handled on a case-by-case basis.

5. AI-Generated Content

Content generated through MySmartAds is produced by artificial intelligence. Users are solely responsible for reviewing generated content before publishing. MySmartAds does not guarantee the accuracy, legality, or appropriateness of AI-generated content. Users must ensure compliance with applicable advertising standards and regulations in their jurisdiction.

6. Intellectual Property

Users retain ownership of content they upload. By uploading content, users grant MySmartAds a license to process that content for video generation purposes. AI-generated videos are owned by the user who generated them, subject to these Terms.

7. Privacy

Your use of MySmartAds is also governed by our Privacy Policy. We collect and process data necessary to provide the Service, including usage data and content you upload for video generation.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Service. Upon termination, unused credits are non-refundable.

9. Disclaimer of Warranties

MySmartAds is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or specific results from AI-generated content.

10. Limitation of Liability

MySmartAds shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service or AI-generated content.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
